Terms of Service

WordNest provides a vocabulary-learning platform that includes spaced-repetition flashcards, AI-generated example sentences and diary corrections, text-to-speech audio, a personal garden room, social features, and progress tracking.

You may use the Service for personal, non-commercial purposes. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms.

Some features use AI services provided by third parties (Google and OpenAI, routed through the Lovable AI Gateway). These features run only when you explicitly trigger them. AI-generated content is provided for learning assistance only and may contain errors.

We may update, change or remove features at any time. We will try to notify users of material changes through the app or by email where appropriate.

To access most features you must create an account. You must provide accurate information and keep your password secure. You are responsible for all activity that occurs under your account.

You must be at least 13 years old to use the Service, or 16 where local law requires it. If you are under the age of digital consent in your country, you may only use the Service with the consent and supervision of a parent or guardian.

You may not share your account credentials, use another person's account, or create multiple accounts to abuse free features, rewards or referrals.

You may delete your account at any time by emailing us at hello@wordnestapp.com from the email address associated with your account. Deletion is usually completed within 30 days.

You agree not to:

• use the Service for any illegal purpose or in violation of any applicable law;
• upload, store or share content that is unlawful, harmful, threatening, abusive, defamatory, obscene, invasive of privacy, or infringing of intellectual property rights;
• enter sensitive personal data into AI features unless you have a lawful basis to do so; in particular, do not submit medical records, government identifiers, payment details or information about other people without their consent;
• reverse engineer, decompile, scrape, data-mine, or otherwise attempt to extract source code or data from the Service;
• interfere with or disrupt the Service, servers or networks, including through bots, scripts, automated tools or excessive API calls;
• impersonate another person, misrepresent your identity, or manipulate rankings, streaks, coins or other systems;
• share decks, words or other content in a way that harasses, abuses or misleads other users.

We may suspend or terminate your account without notice if we reasonably believe you have breached these restrictions.

The WordNest name, logo, graphics, code, lesson content, garden assets, and all other materials provided by us are owned by WordNest or our licensors and are protected by copyright, trademark and other laws.

You retain ownership of the vocabulary decks, diary entries and other original content you create in the Service ("Your Content"). You grant us a non-exclusive, royalty-free, worldwide licence to host, store, process and display Your Content solely for the purpose of operating and improving the Service.

You may not use the WordNest trademark or logo without our prior written permission. Open-source or third-party components used in the Service remain subject to their own licences.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful code.

AI-generated examples, corrections, audio and translations are provided for learning purposes only. We do not guarantee their accuracy, completeness or fitness for any particular purpose.

Nothing in these Terms affects your statutory rights as a consumer under the law of your country of residence, including the United Kingdom and EU member states, where mandatory consumer protections cannot be excluded.

To the fullest extent permitted by applicable law, WordNest and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill or opportunity arising from your use of or inability to use the Service.

Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD 100 if you have not paid anything.

This limitation does not apply to liability that cannot be excluded under applicable mandatory law, including death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights in the UK or EU.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, pose a security risk, or are legally required to do so.

You may stop using the Service at any time. Upon termination, your right to access the Service ends immediately, but provisions relating to intellectual property, disclaimers, liability and governing law will survive.

If you have a paid subscription, termination or refund rights may be governed by the separate payment terms presented at the time of purchase and by applicable consumer protection law.

These Terms are governed by and interpreted in accordance with the laws of Estonia, without regard to its conflict-of-law provisions.

If you are a consumer resident in the European Union or United Kingdom, you also benefit from any mandatory provisions of the law of the country in which you are resident. Any dispute will first be handled through good-faith direct contact with us.

For disputes that cannot be resolved informally, disputes with consumers resident in the EU may be submitted through the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr. We are not obliged to participate in alternative dispute resolution, but we will respond to any submission in good faith.

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms and, where appropriate, through the app or by email. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store and protect your personal data, including data processed by Supabase, AI providers and push-notification services. In case of any conflict between these Terms and the Privacy Policy regarding data protection, the Privacy Policy prevails.
